Welcome to The Windy Tee. These Terms and Conditions outline the rules and regulations for the use of The Windy Tee's website (www.thewindytee.co.nz) and our venue located in Brewtown, Upper Hutt, New Zealand.

By accessing this website and/or engaging our services, we assume you accept these terms and conditions in full. Do not continue to use The Windy Tee's website or services if you do not accept all of the terms and conditions stated on this page.

1. General Definitions

• "The Business", "We", "Our", and "Us" refers to The Windy Tee.
• "Client", "Member", "You", and "Your" refers to you, the person accessing this website or entering into a corporate partnership with us.
• "Venue" refers to our physical premises located within the Brewtown precinct, Upper Hutt.

2. Corporate Memberships & Founding Partnerships

• Transferability: Corporate Platinum and Gold memberships are fully transferable assets. This means the primary account holder (the Founding Business) may allocate simulator time to their staff, clients, or partners.
• Responsibility: The Founding Business remains ultimately responsible for the conduct of any guests, clients, or staff using the venue under their membership tier.
• Duration & Renewal: Membership terms and renewal periods will be outlined specifically in your Founders Agreement.

3. Venue Use & SafetyThe Windy Tee utilizes premium Trackman simulator technology. To ensure a safe and premium environment for all guests:

• Only provided or approved golf balls may be used on the simulators.
• Guests must stay within designated safe zones while a player is swinging.
• Damage Liability: The Client is liable for any deliberate, reckless, or negligent damage caused to the Trackman sensors, impact screens, or venue property by themselves or their guests.

4. Food, Beverage & "The Turn"

• The Windy Tee operates a premium non-alcoholic beverage bar known as "The Turn."
• We proudly partner with neighbouring Brewtown businesses for catering and specific hospitality requirements.
• Outside food and drink are not permitted unless explicitly arranged with management for private corporate functions.

5. Bookings & Cancellations

• All simulator bays and corporate hosting spaces must be booked in advance.
• Cancellation policies for corporate functions and individual bay hires will be provided at the time of booking. Failure to show up for a booked session may result in a deduction of allocated hours from your corporate tier.

6. Limitation of LiabilityTo the maximum extent permitted by New Zealand law, The Windy Tee shall not be held liable for any personal injury, loss, or damage to personal property (including golf clubs and equipment) that occurs within the venue, except where such injury or damage is caused by our direct negligence.

7. Governing LawThese Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of New Zealand.
